Terms of use of this site

These terms govern the reading of this site, and nothing else. No service, no software licence and no service level commitment follows from them.

01 Purpose

These terms govern access to www.nudibranches.tech and the reading of its content. They apply from the first page you open, with no step required from you.

They govern no service. An engagement, a subscription to the Hyperfluid product or a usage licence are the subject of a separate signed written contract, which prevails over this document in the event of divergence.

This site has no account, no client area and no online purchase. There is nothing to create, nothing to subscribe to and nothing to pay for here. The only action available is writing to us.

02 What this site publishes, and what it is worth

The content of this site is informational. Published figures come with their scope, their method and their cut-off date, recorded in the source register; they describe past engagements and are neither a projection nor a commitment as to results.

No page of this site constitutes an offer. A commitment from us requires a signed quote or contract, and reading a page replaces neither. §

Technical descriptions hold as at the stated cut-off date. A software version, a deployment topology or a responsibility matrix may change between two readings: that is why every assertion carries its date.

03 Intellectual property and quotation

The editorial content of this site is protected. You may quote an extract, reproduce a table or forward a whole page as part of a consultation, a tender or an internal review, provided you name the source and the page address.

Reproducing content in full in a commercial document, republishing it under another name, and using our trademarks or visual identity require written agreement.

The software we publish is not governed by this document: each repository carries its own licence, and that licence is what applies.

04 Acceptable use

By reading this site, you undertake not to:

  • attempt to access a non-public part of the site or of its publication chain;
  • harvest its content at scale by automated means in a way that would degrade its availability;
  • reproduce it or imitate its identity so as to create confusion about its origin;
  • use the addresses published here for unsolicited prospecting.

Vulnerability research carried out in line with our disclosure policy does not breach the first point: it is expressly authorised there, within the limits that policy sets.

05 Outbound links

This site links to code repositories, legal texts and third-party sites. We have no control over those destinations, and their content binds only their own publishers. A link is not an endorsement.

06 Availability

This is a publishing site, not a service. It may be interrupted for maintenance, updates or a change of host, without notice and without compensation. No service level is attached to it.

The availability commitments that apply to our work are set out in the relevant contract, never on a website page.

07 Liability

We take real care over the accuracy of what is published here, and we correct what is reported to us. We do not, however, warrant that the content is exhaustive or permanently up to date; what you do with it is your own judgement.

To the extent permitted by applicable law, we are not liable for indirect loss arising from access to this site or from being unable to access it.

We neither exclude nor limit our liability for wilful misconduct, gross negligence or personal injury. French law does not allow it, and a clause claiming otherwise would be deemed unwritten: we would rather write that down ourselves. §

08 Personal data

Reading this site gives rise to the processing described in the privacy policy: contact form and cookieless audience measurement. That policy forms an integral part of these terms.

09 Changes to these terms

We may amend these terms. The applicable version is the one published on this page on the day you read it, and it carries its cut-off date at the top.

A substantive change is dated. We do not rewrite an earlier version without changing the date, and we state below which version this one replaces.

Previous version: 22 August 2024, written in English including in the French edition, and referring to an account registration that never existed on this site. This version fixes both.

10 Governing law and jurisdiction

These terms are governed by French law, including when the site is read from another country.

Any dispute over their interpretation or performance falls to the courts having jurisdiction where the publisher's registered office is located, unless a mandatory rule provides otherwise.

If you are a consumer, you keep the right to bring proceedings before the court of the place where you lived when the contract was concluded or when the harmful event occurred, and to use a consumer mediator. No clause in this document takes that away. §
